1. Acceptance of Terms
By accessing and using the Rakpublika website, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
2. Description of Service
Rakpublika provides users with access to a rich collection of resources, including various communications tools, forums, and personalized content (the "Service"). You understand and agree that the Service is provided "AS-IS" and that Rakpublika assumes no responsibility for the timeliness, deletion, mis-delivery, or failure to store any user communications or personalization settings.
3. User Conduct
- Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
4. Rakpublika-Produced Content & Performances
Rakpublika actively produces, records, and films live music performances and video content featuring independent and signed artists. By agreeing to participate, perform, or be recorded by Rakpublika, artists and their representatives grant Rakpublika a perpetual, non-exclusive, royalty-free, worldwide license to use, host, reproduce, distribute, and publicly display the resulting video and audio recordings on the Rakpublika platform. Rakpublika retains full ownership of the master recordings and video files produced by our team, while the artist retains all underlying rights to their original musical compositions and lyrics.
5. Royalty & Compensation Waiver
Unless explicitly agreed upon in a separate, written contract between Rakpublika and the artist (or their record label/management), all performances recorded by Rakpublika are strictly promotional. By participating, artists, labels, and rights-holders explicitly waive any right to demand financial compensation, royalties, or licensing fees from Rakpublika for the playback, streaming, or display of the specifically produced performance on our platform.
6. Embedded Third-Party Content (e.g., YouTube)
Rakpublika may embed or link to videos, music, and media hosted on third-party platforms such as YouTube. We do not host this content on our servers, nor do we claim any ownership over it. All embedded content remains the property of its respective owners and is subject to the terms of service of the hosting platform. If you believe an embedded video infringes your copyright, you must direct your takedown request to the host platform (e.g., YouTube), as their removal of the video will automatically remove it from Rakpublika.
7. Copyright & DMCA Policy
Rakpublika respects the intellectual property rights of others. If you are a copyright owner or an agent thereof and believe that any locally hosted user-submitted content or improperly licensed media directly on our platform infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our designated Copyright Agent with the necessary information to process a takedown request. Rakpublika holds no liability for copyright infringements, and our sole responsibility is to remove the infringing content upon receiving a valid legal notice.
8. Intellectual Property (Platform)
Excluding third-party artist IP and embedded content, all other content included on this site, such as platform text, application graphics, logos, button icons, and software code, is the property of Rakpublika and protected by international copyright laws.
9. Disclaimer of Warranties
You expressly understand and agree that your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Rakpublika expressly disclaims all warranties of any kind, whether express or implied. Rakpublika does not endorse, guarantee, or assume responsibility for any audio, video, or media content published or embedded on the platform by independent or signed artists.
10. Limitation of Liability
Rakpublika, its administrators, and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use or the inability to use the service, or liability arising from the display, playback, framing, embedding, or hosting of third-party audio or video materials.
